A US judge ordered the opening of a new trial to determine if Samsung Electronics should pay Apple for copying the iPhone's design for their Galaxy series on Sunday.
US District Judge Lucy Koh from San Jose, California issued the trial 10 months after the US Supreme Court set aside a $399 million award against Samsung for copying Apple's designs for its smartphone series. According to the Supreme Court's decision, the damages are based on parts of the device that may have infringed patents, but it cannot be based on the entire design.
According to Koh, the jury's instructions at the trial "did not accurately reflect the law" and may have shown prejudice on Samsung by stopping jurors from considering whether infringement also included "something else other than the entire phone."
The $399 million award is only a part of the $548 million payment Samsung has to pay to Apple in December 2015.
Apple has immediately responded on the new court order, saying that there is no need for a new trial. It adds that the $399 million award should be confirmed. However, it did not respond to comment requests on Monday regarding their full stance on the issue.
Samsung, on the other hand, is thankful for the order and welcomes it.
